Terms of Service for Marian Gradely

Welcome to Marian Gradely: SMU Mobile Grading App ("Marian Gradely", "the App"). By downloading, installing, or using this application, you ("User", "Instructor", "Educator") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use the application.
1. Description of Service
Marian Gradely is an offline-first mobile academic tracking and grade management platform designed for professional educators. The App facilitates grade computation, student roster management, data backups, and report generation (PDF and Excel format).
2. User Accounts & Google Cloud Integration
Authentication & Permissions: To utilize cloud features—such as automated database backup, roster retrieval, class transfers, and attendance reporting—you must authenticate using a Google Account.
Google Drive API (drive.file): The App requests permission to access Google Drive restricted exclusively to files explicitly created by or designated for Marian Gradely (e.g., database backups and class transfer JSON files).
Gmail API (gmail.send): The App requests permission to dispatch email notices (such as absence warnings) directly from your Google Account. Access is strictly limited to sending outgoing messages initiated by you. The App NEVER accesses, reads, stores, or modifies your personal emails, inbox messages, or Gmail contacts.
Data Isolation & Sandboxing: The App operates under strict sandboxing protocols. It requested permission to access Google Drive is restricted exclusively to files explicitly designated for, or created by, Marian Gradely (e.g., the Marian Gradely Transfers folder).
Android Work Profiles: Users must ensure that the Google Account used to download the App from the Google Play Store matches the account configured for cloud storage. The App cannot cross-authenticate or share data between Android Personal Profiles and Android Work Profiles (briefcase icon 💼) due to system-level security constraints.
3. Attendance Reporting & Email Dispatches
User Review & Consent: All email reports generated by Marian Gradely—including student absence notices—are created as editable drafts within the App. No email is dispatched automatically without explicit action from the instructor. You are solely responsible for reviewing the email subject, recipient address, and body content before tapping "Send."
Dispatch Mechanics: When you confirm an email send action, the App utilizes the Gmail API to transmit the message directly via your authenticated Google Account. The App marks the report as dispatched only upon receiving a successful confirmation response from the server.
Recipient Accuracy: You are responsible for ensuring that the student and parent/guardian email addresses stored in your class rosters are accurate and up to date.
4. Data Governance & User Responsibility
Offline-First Local Storage: Marian Gradely stores raw scores, student identifiers, and grades locally on your device's internal storage. You are solely responsible for managing local storage and maintaining the security of your device.
Data Integrity & Irreversible Deletion: The App features a "Trash Bin" safety net for deleted classes, student rosters, and academic activities. However, choosing "Delete Forever" or manually clearing the Trash Bin results in an irreversible, permanent erasure of data from the device. The developer cannot recover data lost through permanent deletion actions.
Accuracy of Institutional Rules: The App provides automated transmutation standards (Flexible, Minor, Major, Review) and institutional policies (e.g., awarding a restricted 75% raw score for unexcused absences, handling Incomplete "INC" grades via NFE status). Instructors are responsible for applying the correct administrative standards corresponding to their designated course load.
5. Class Records Transfer Policy
When transferring a class record to a successor instructor due to administrative adjustments or load changes:
Original Instructor: Initiating a transfer packages class data into a secure JSON file sent to a designated Marian Gradely Transfers folder on Google Drive. The local copy becomes a "Read-Only" historical snapshot in your Archive section. You are responsible for inputting the correct, verified email address of the receiving instructor.
New Instructor: Upon accepting and importing the shared JSON file, you assume full stewardship of the class data. The class record will decouple from the previous instructor's account and link to your Google Drive for future backup cycles.
6. Privacy and Security
Your use of the App is also governed by the Marian Gradely Privacy Policy. The App features built-in Biometric Authentication options (Fingerprint / Face Unlock). Activating these features to safeguard sensitive student data against unauthorized local access is highly encouraged.
6. Prohibited Uses
You agree not to:
Modify, reverse-engineer, decompile, or attempt to extract the source code of the App.
Use the App to store or process fraudulent, unverified, or unauthorized academic records.
Intentionally upload corrupted XML files or malicious JSON structural payloads to disrupt the App's grading engine.
7. Disclaimer of Warranties & Limitation of Liability
Marian Gradely is provided on an "as-is" and "as-available" basis. While designed to secure and streamline academic grading workflows, the developer does not warrant that the App will be entirely error-free or that local data cannot be compromised through device loss, unauthorized hardware tampering, or OS-level failures.
In no event shall the developer be liable for any direct, indirect, incidental, or consequential damages—including, but not limited to, the loss of student grade records, grading disputes, or technical data corruptions—arising out of the use or inability to use the App.
8. Modifications to Terms
We reserve the right to modify or replace these Terms at any time. Continued use of the App after any modifications constitutes acceptance of the updated Terms.
